The Haut Rhin Departmental Board

The Haut Rhin Departmental Board of doctors has been responsible for the administration in connection with the profession of the medical doctors and has been existing for the past 60 years. It is a statutory body whose administration representatives are democratically legitimated through elections, and who is responsible for protection of the professional interests of the doctors. Each medical doctor has to be a member of the Board.
- The tasks of the Board of the Haut Rhin are ruled by the law. They regularly deal with :

Safeguarding good medical care of the population by a constant exchange of experience between the medical associations and a mutual harmonisation of their goals and activities.

Exchange of opinions and experience between the medical associations of the Haut Rhin.

Promotion of quality assurance ; adoption of rules, particularly in the professional legal code.

Regulation of ethical and professional obligations of doctors among the profession and toward the patients. Post graduate / Vocational training regulation and promotion. Define the contents, duration and objectives of post-graduate training and specialist designations. Ensuring the best possible standardisation of professional medical duties and principles for medical activity in all fields.

Safeguarding the professional interests of the medical profession in the matters exceeding the sphere of responsibility of the local Board. Conveying the standpoints of the medical profession in terms of health policy. Drawing up/ updating medical statistics. Establishing relationships with the medical scientific community and medical associations abroad (especially in Germany and Switzerland).

- Missions devoted to the departmental council of the Board of the Haut Rhin:

The local Board acts, under the control of the National Council, as clearly defined in the article L.4121-2 of the Public Health Code. Its ensures the respect of the laws and rules which govern the Board and the practice of the profession. It authorizes the president of the Board to be party to legal proceedings, to manage the Board's assets.

The departmental council has for essential role to ensure the registration of the members In the administration field, it gives decision according to the medical code of ethics. With regards to disciplinary matters, the departmental council does not have decision-making power, but it is entitled to seize the ordinal jurisdiction either on its own initiative, or following a complaint which it must obligatorily pass on to the regional council together with a counsel's opinion (article L4123-2 of the Public Health Code).

It watches over the execution of the sentences pronounced by the disciplinary jurisdiction. Generally speaking, it watches over the execution of the decisions and the rules or instructions taken or established by the National Board. Moreover, it has a capacity of conciliation in disputes arising between patients and doctors (Article L.4123-2 of the Public Health Code), or between doctors themselves (Article 56 of the Medical Code of Ethics), or even between doctors and administration.

Each departmental council has funds for mutual aid and can thus immediately come to assistance to medical families in a sudden distress. The departmental council also has to play a role of advisor towards all the doctors and particularly the young fellow-members opening a new practice. Locally, the departmental council has a representative role nearby the government authorities, in particular nearby the county administration and near the magistrates with whom the contacts are frequent.
